Title 42 Continues to be a Barrier for Immigrants Entering the Country

Title 42 will continue as a federal judge in Louisiana ordered that pandemic-related restrictions are the reasoning behind expelling migrants from entering the border. The Trump Administration first implemented this restriction against immigrants thanks to the Center for Disease Control and Prevention, which chose to invoke its authority under the decades-old law.

“The authority to set public health policy nationally should rest with the Centers for Disease Control, not with a single district court.” However, in compliance with the court’s injunction, the Biden Administration will continue to enforce the CDC’s 2020 Title 42 public health authority pending the appeal, “White House press secretary Karine Jean-Pierre said in a statement.

According to Dr. Anthony Fauci, the nation’s top infectious disease expert, immigrants are not increasing the number of COVID-19 cases.

“This is not driven by immigrants. This is the problem within our country, the same way it’s a problem with other countries throughout the world,” he said. “The idea, when you have 700,000 Americans dead and millions and millions and millions of Americans getting infected that, you don’t want to look outside to the problem. The problem is within our own country.”

Under Title 42, nearly 97,000 migrants were removed, while over 15,000 migrants were removed under Title 8, a pre-pandemic deportation authority. 

According to the Customs and Border Protection data, 234,088 migrants were stopped and arrested last month beside the southwest border, highlest monthly total.
